Divorce mediation provides a mechanism for
the couple to come to an agreement on all the issues of each family member's
future well-being. The mediator can lay out what the issues are and what
the applicable legal guidelines are. The parties themselves decided on the
answers that they can live with. However, divorce is still a legal matter,
with long term rights and obligations. We suggest that, once the parties
have reached their own agreement, each member of the couple have that agreement
reviewed by an attorney representing only their interests, to make sure
that they understand what they have agreed to, the legal consequences of
the agreement, and that the terms of the agreement are what they are prepared
to live with. We have found that most clients feel that the mediation process
has sufficiently informed them, do not want the added expense of additional
attorneys to merely review the agreement, and ask our legal staff to prepare
the legal papers and process the divorce. The divorce then proceeds as any
uncontested matrimonial would. |
