When is Divorce Mediation not appropriate?

Divorce mediation is not a cure-all. It requires that both parties are willing to be honest with each other on financial and parenting issues and able to get beyond their hurt and angry feelings sufficiently to come to an agreement. If one party is lying about financial resources; if one party is out for revenge; if one is out to hurt the other no matter what the cost to him or herself or to the children - mediation is not going to work. For people who are determined to fight to the death the courts are the appropriate forum. Other instances where mediation is probably inappropriate are where one of the parties is incapable of understanding what is being decided, utterly passive and unwilling to participate, or completely unsophisticated compared with the other in discussing the issues. In that instance separate attorneys might well be more appropriate.
